<h1>1. Purpose</h1>
The purpose of this policy is to inform candidates about how their personal information will be collected, used and protected by Explorers Early Learning and how records can be accessed. 
This policy should be read and interpreted in conjunction with the National Employment Standards (NES), the Fair Work Act 2009 (Cth) and the Fair Work Regulations 2009 (Cth) (as amended or replaced). 
<h1>2. Application</h1>
This policy applies to all candidates of Explorers Early Learning.
<h1 style="margin: 0in 0in 12pt; text-align: justify; line-height: 107%; font-size: 11pt; font-family: Aptos, sans-serif;">3. Australian Privacy Principles (APPs)&nbsp;</h1>
The Australian Privacy Principles (APPs) are contained in the Privacy Act 1988 (Cth) and cover the following: 
<ul style="margin-bottom: 0in; margin-top: 0px;">
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">the open and transparent management of personal information (including having a privacy policy); </li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">an individual having the option of transacting anonymously or using a pseudonym where practicable; </li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">the collection of solicited personal information and receipt of unsolicited personal information including giving notice about collection; </li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">how personal information can be used and disclosed; </li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">maintaining the quality of personal information; </li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">keeping personal information secure; and </li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">right for individuals to access and correct their personal information. </li>
</ul>
<h1>4. Employee records exemption&nbsp;</h1>
The handling of personal information by private sector employers, including Explorers Early Learning, is exempt from the Privacy Act 1988 if the personal information relates directly to an employee record of a current or former employee. This means that Explorers Early Learning does not need to comply with the Australian Privacy Principles (APPs) when it handles current and past employee records.

The following are types of information that Explorers Early Learning collects and holds:

<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">General employment details (i.e. Candidates&rsquo; commencement date and type of employment);</li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">Personal details (i.e. Name, address, email address and phone number);</li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">Residency information, including visa and passport details;</li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">Records of academic qualifications, memberships, and certifications;</li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">Averaging of hours agreements;</li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">Records relating to leave entitlements;</li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">Records relating to superannuation contributions;</li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">Records relating to individual flexibility arrangements; and</li>
<li style="margin: 0in 0in 0in 0px; text-align: justify; line-height: normal; font-size: 11pt; font-family: arial, helvetica, sans-serif;">Records relating to guarantees of annual earnings.</li>

4.2 Collection, use and protection of records&nbsp;
4.2.1 Collection of personal information&nbsp; 
Explorers Early Learning will only collect and hold personal information that is relevant to and necessary for the employment relationship.
Explorers Early Learning will collect your personal information directly from you by email, telephone, online form, Explorers (EEL) recruitment platform, recruitment agencies or indirectly through alternate sources such as Linkedin, referees, etc.

Explorers Early Learning will ensure that personal information will only be used or disclosed for the purpose for which it was collected unless the law requires or permits use or disclosure for another purpose or consent is provided by the Candidate to use or disclose the information for another purpose.

Explorers Early Learning will securely store and protect personal information from misuse, interference, loss, unauthorized access, modification, or disclosure. Soft copies will be stored in protected databases with access limited to authorized members via secure credentials. Hard copies will be kept in secure receptacles within a protected office environment and disposed of in secure bins for proper destruction.

Upon request from the Candidate, Explorers Early Learning must make a copy of collected personal information available (in a legible form) for inspection and copying.
If the candidate&rsquo;s personal information is stored at the premises,&nbsp;Explorers Early Learning will make a copy available at the premises within 3 business days of receiving a request or post a copy of the candidate&rsquo;s personal information within 14 days after receiving a request.
If the Candidate&rsquo;s personal information is not stored at the premises, Explorers Early Learning will, as soon as practicable after receiving a request, make a copy available at the premises or post a copy of the Candidates personal information to the Candidate.
<h2 style="text-align: justify; margin: 8pt 0in 4pt; line-height: 107%; break-after: avoid; font-size: 16pt; font-family: 'Aptos Display', sans-serif; color: rgb(71, 145, 64); font-weight: normal;">4.4 Request for Deletion</h2>
Candidates may request the deletion of personal information and cessation of further use by Explorers Early Learning. To do so, please contact careers@explorers.com.au.
Explorers Early Learning may refuse this request in the unlikely event that such a request is not permitted by law and in such circumstances, provide reasons for refusal.
Upon receipt of a valid request for deletion of personal information, Explorers Early Learning will within 30 days delete the relevant information.
<h2 style="text-align: justify; margin: 8pt 0in 4pt; line-height: 107%; break-after: avoid; font-size: 16pt; font-family: 'Aptos Display', sans-serif; color: rgb(71, 145, 64); font-weight: normal;">4.5 Third party access to records </h2>
Explorers Early Learning must comply with the&nbsp;Australian Privacy Principles (APPs) when providing employee information and/or records to third parties. Unless consent is provided, Explorers Early Learning will only disclose personal information to third parties for the purpose that it was originally collected or a closely related purpose that employees would reasonably expect.
<h1>5. Health records&nbsp;</h1>
The Australian Privacy Principles (APPs) do not apply to employee health records.
In Victoria, the Health Records Act 2001 (HR Act) protects health information handled by Victorian public and private sector employers. The HR Act applies to employee records (including health records). Explorers Early Learning must and will comply with its obligations under the HR Act.&nbsp;
Explorers Early Learning must and will comply with its obligations under any state or territory privacy laws dealing with the protection of personal health information.&nbsp;
<h1>6. Complaints</h1>
If you believe that Explorers Early Learning has interfered with your privacy, you have the right to complain about the handling or use of your personal information. Please submit your complaint to us in writing, in the first instance. Explorers Early Learning takes all complaints seriously and will address your concerns promptly.
