Overview

At Fossil Group, Inc., together with its subsidiaries and affiliates and owned brands, (“Fossil”, “Fossil Group”, “we”, “us” or “our”), we value your data protection rights. This privacy policy for job applicants (the “Privacy Policy”) governs the processing of information provided or otherwise obtained during your job application process, including any information collected via the Fossil-owned sites where the job descriptions and applications are linked (individually and collectively, the “Website(s)”).

We follow this Privacy Policy in accordance with applicable law in the places where we operate. In some cases, we may provide additional data privacy notices specific to certain products, practices, or states. Those terms are to be read in conjunction with the rest of this Privacy Policy.

Please note that:

This Privacy Policy only governs the application process. If you’re hired by Fossil, your employee data will then be governed by a different privacy policy.
Fossil uses a third party service provider, Dayforce, Inc. (“Dayforce”), as our global application and recruitment platform. For more information on Dayforce, please see Dayforce's Service Provider Privacy Statement.

Personal Information We Collect

“Personal Information” is information that can be used either directly or indirectly to identify you. The Personal Information we may collect about you depends on your interactions with us and the Websites. We may collect the following categories of Personal Information during your recruitment process:

Registration information you provide if you create an account on the Dayforce Job Application Portal (“Portal’’), such as your first and last name, email address, username and password;
Identification information you provide either on the Websites, Portal or on your CV/motivation letter, such as your first and last name, email address, residential address, telephone number, photo, and any social media accounts;
Demographic information that you provide, such as your gender, age and date of birth;
Professional information you provide, such as your employment history, educational background, compensation information, performance objectives, skills, reference contacts, work eligibility (e.g., work permit requirement or visa status) and any other information on your submitted CV/motivation letter;
Interview information that we collect about you during your interview(s);
Communication information if you contact us, such as the content of emails, text messages, or other communications (only where we are the recipient of such communications);
Technical information we collect through the device you applied, such as your IP address, device name, location data, time and date of your application;
Sensitive information you optionally want to share with us, such as any health data, racial or ethnic origin, religious or philosophical beliefs, trade union membership, sexual orientation, citizenship or immigration status.

How We Obtain Your Personal Information

We may obtain and combine Personal Information from different sources, collected online and offline. See below for details on how we may obtain your Personal Information:

From you. We receive Personal Information from you or your actions, be it because you provided us Personal Information (i) during the account creation process, (ii) through submitting your CV/motivation letter to us, (iii) during your interviews, and/or (iv) through communication between you and us.
From publicly available social media accounts (e.g., LinkedIn). We may receive your Personal Information from your social media accounts, if they are open to the public.
From other Fossil Group companies. We may receive your Personal Information from other Fossil Group affiliates and/or subsidiaries, if you previously shared any Personal Information with them.
Through the use of certain online technologies. We may collect information from our Websites and the Portal through a variety of technologies, such as cookies, Flash cookies, pixels, tags, software development kits, application program interfaces, and Web beacons. For more information, see the “Cookies & Similar Online Tracking Technologies” section of this Privacy Policy; and
From our third party service providers. We may receive your Personal Information from our third party service providers, such as our background check providers (where applicable).

How We Use Your Personal Information

In order to effectively handle your job application and recruitment process, we and our service providers may collect and use your Personal Information for the following purposes:

Assessing your application and your suitability for employment, including the verification of references and qualifications;
Contacting and engaging with you throughout the recruitment process;
Managing interviews, assessments, feedback;
Creating a candidate profile for future roles (if you consent to it);
Detect, investigate and prevent activities that may violate our policies, pose safety issues, or be fraudulent or illegal; and
Comply with our legal or regulatory obligations, establish or exercise our rights, and defend against a legal claim.

On What Legal Basis We Process Your Personal Information

Please find below the legal bases for every processing activity as required in the EU and the UK according to the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and the retained EU law version of the General Data Protection Regulation (“UK GDPR”), both hereinafter referred to as GDPR (where applicable):

When you provide your Personal Information to us yourself with your consent [Art.6(1)(a)];
When the processing is necessary before entering into an employment contract with you [Art.6(1)(b)];
Where processing your Personal Information is necessary to comply with legal and regulatory requirements [Art.6(1)(c)];
Where we process your Personal Information in accordance with our legitimate interest to evaluate your application and improve our recruitment processes [Art.6(1)(f)].

If and to the extent that we rely on the legal basis of legitimate interest, we made a balance between the legitimate interests that we pursue as the controller and your interests and fundamental rights and freedoms, which require the protection of personal data, to justify our reliance on this legal basis.

Please note that we may also, where India’s Digital Personal Data Protection Act, 2023 requires us to, rely on your consent to process your Personal Information. In such cases, we may provide you with separate or in-time notices to seek your consent. To the extent permitted by India’s Digital Personal Data Protection Act, 2023, you are entitled to withdraw your consent for any processing activity specified under this Privacy Policy.

Who We Share Your Personal Information With

We may share your Personal Information in the following cases:

Legal obligation and internal purposes. We disclose your Personal Information:
- in order to comply with relevant laws, regulatory requirements and to respond to lawful requests, court orders, and legal processes, including requests to meet national security or law enforcement requirements;
- in order to protect and defend the rights or property of us or third parties; and/or
- in an emergency, in order to protect the safety of our employees or any person.
Joint processing within Fossil Group. Your information may be shared with our internal recruiters and hiring managers, and other Fossil Group companies for internal purposes and as a part of your recruitment process. We base this joint processing on an intra group agreement, allocating the responsibilities of the respective group entities. For you, as a candidate, this means that the Fossil entity you are in touch with / applied to is responsible for processing your data and answering your requests. If you are not sure about the entity responsible in your case, please contact privacy@fossil.com.
Sharing with third parties. We may engage third-party service providers who are allowed to use Personal Information only on our behalf and must not use it for their own purposes, unless permitted by law. We ensure that your Personal Information is protected by written agreements with them. The following is a list of categories of services and functions along with example recipients:

to enable the functionality of our online application portals (e.g. Dayforce);
to conduct necessary background checks (only where applicable); and
providing hosting and general IT services and administration (e.g. Amazon Web Services and Google).

Transfer of Assets. We may transfer your Personal Information to a third party in the event of a transfer of all or some of our assets to a third party, such as a merger, acquisition or novation.
International Transfer. Your Personal Information may be transferred and stored in countries outside your own, including the United States. In such cases, appropriate safeguards are in place to ensure the safety and protection of such data in compliance with applicable data protection laws, such as entering into the Standard Contractual Clauses for the transfer of Personal Data to third countries pursuant to Regulation (EU) 2016/679 of the European Parliament and the Council approved by European Commission Implementing Decision (EU) 2021/914 of 4 June 2021 where necessary and applicable.

How Long We Maintain Your Personal Information

We will retain your Personal Information (a) as long as necessary to conduct and finalize your recruitment process, (b) as long as reasonably necessary to further our legitimate interests, where permissible under applicable law, or (c) as long as we are required by law. If your application process is not concluded with actual employment with us, we delete your Personal Information after 12 months, unless you gave your consent to us for keeping it longer for possible future roles.

Data Storage and How We Keep Your Personal Information Safe

We may store and process your Personal Information in any country where a Fossil Group entity and/or authorized third parties operate, though the majority of Personal Information is stored in Germany and the United States. Thus, your information may be subject to U.S. and foreign laws and accessible to U.S. and foreign governments, courts, law enforcement and regulatory agencies. In all cases, we ensure an adequate level of data protection for such data transfers and storage, where your Personal Information is subject to data protection laws and regulations of EU/EEA/UK/Switzerland. Where required, we use contracts with Standard Contractual Clauses approved by the European Commission and supplement the contracts with adequate security measures in such a way that these measures comply with the EU/EEA/UK/Switzerland data protection principles.

We may use the Personal Information we collect to generate de-identified data that cannot reasonably be used to identify you. Fossil may maintain and use de-identified data without attempting to re-identify the data and contractually obligates recipients of such data to do the same. Moreover, we have implemented commercially reasonable physical, organizational, contractual and technological security measures with a view to protecting your Personal Information and other information from loss or theft, unauthorized collection, use and disclosure.

Despite the measures outlined above, no method of information transmission or information storage is 100% secure or error-free, so we unfortunately cannot guarantee absolute security. For example, you must also do your part, such as by keeping your credentials safe.

Cookies & Similar Online Tracking Technologies

We may utilize trackers, such as cookies, pixels, tags or similar tracking technologies, on our Website(s). For more information, please consult the privacy policy linked within the footer section of such Website.

Artificial Intelligence

We may leverage artificial intelligence technology (“AI”) to help increase our efficiency. For example, we may use AI to track which applicants suit the job description best.

We ensure compliance with the Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 2024 laying down harmonised rules on artificial intelligence (“AI Act”), in cases where we are using / planning to use any AI on our Websites. Please note that we do not make recruitment decisions solely based on automated decision-making and/or AI. Human oversight and interaction will always be included during your recruitment process.

Your Rights

You have rights on certain information we collect about you, how we communicate with you, and how we process certain Personal Information. Your rights may vary depending on where you are applying from and to which Fossil entity you are applying to.

Applications from Third Party Sites

Whenever you apply for a job with us via a third party website/application (such as LinkedIn Corporation or Indeed, Inc., etc.), you will be directed to our Dayforce Application Portal and your Personal Information will be handled in accordance with this Privacy Policy and the Dayforce Service Provider Privacy Statement .

Please note that the data processing activities and procedures of other third party sites are not under our control. In such cases, we are not responsible for compliance with the applicable data protection regulations of those sites. We recommend that you carefully read the privacy statements of these third parties to learn how your Personal Information is stored, used or shared.

Modifications to this Privacy Policy

This Privacy Policy is effective as of the date provided above and may be revised from time to time. We will notify you of material changes by posting a prominent notice on our Websites / Portal or by sending you an email.

GDPR and California-State Specific Rights

Depending on which Fossil entity you are applying to or where you live, you may be entitled to additional rights with respect to the Personal Information we have about you. The following sections describe those rights. These sections should be read in conjunction with the rest of the Privacy Policy.

1. GDPR Rights

You have the following rights regarding your Personal Information under GDPR, where applicable:

2. California Rights

This section applies to California residents, as required by the California Consumer Privacy Act of 2018 (as amended by the California Privacy Rights Act of 2020). These sections should be read in conjunction with the rest of the Privacy Policy.

2.1. Categories of Personal Information Collected

In the preceding 12 months, we have collected the following categories of Personal Information about California residents:

Identifiers, such as real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, social security number, driver's license number, passport number, and/or other similar identifiers;
Personal Information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)) such as signature, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history;
Sensitive Personal Information, such as Social Security numbers and /or precise geolocation
Protected classification characteristics under California or federal law, such as age (40 years or older) and/or sex (gender); and
Inferences drawn from other personal information such as a profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

From the Use of Certain Online Tracking Technologies; and
Through third-party sources.

2.3. How We Use Your Personal Information

We may use your Personal Information for the purposes described in the “How We Use Your Personal Information” section of the Privacy Policy and re-provided below:

Contacting and engaging with you throughout the recruitment process;
Assessing your application and your suitability for employment, including the verification of references and qualifications;
Managing interviews, assessments, feedbacks;
Creating a candidate profile for future roles if you consent to it;
Detect, investigate and prevent activities that may violate our policies, pose safety issues, or be fraudulent or illegal; and
Comply with our legal or regulatory obligations, establish or exercise our rights, and defend against a legal claim.

2.4. Disclosing Personal Information

We may disclose your Personal Information in the following circumstances:

To a Fossil Group affiliates or subsidiary for joint processing;
To authorized service providers that we use to help deliver benefits and services related to your prospective or actual employment, such as identity verification providers, payment service providers, time and attendance programs, benefits programs, etc.;
Third parties approved by you (e.g., your legal counsel, assessment and background check providers, and others);
To a third party in the event of a transfer of asset and/or change of ownership; and
Law enforcement, government entities, and pursuant to the legal process where required by law.

2.5. Sale and/or Share of Personal Information

In the preceding 12 months, we have not Sold or Shared Personal Information that is subject to this Privacy Policy.

2.6. Your California Privacy Rights

If you are a California resident, you have the following rights:

Right to Access: You have the right to know and see what personal data we have collected about you in a usable format. Specifically, you can request the following information:
- the categories of Personal Information we collected about you;
- the categories of sources from which the Personal Information is collected; and
- the specific pieces of Personal Information we have collected about you.
Right to Delete: You have the right to request that we delete the personal data we have collected about you, subject to applicable legal exceptions.
- Please note that choosing to delete your Personal Information will impact our ability to contact you for future job opportunities, should you be so interested.
Right to Correct: You have the right to request that we correct inaccurate Personal Information.
Right to Opt Out of the Sale/Share of Personal Data: Although you have the right to opt out of the Sale or Sharing of your Personal Information, we do not Sell or Share Personal Information subject to this Privacy Policy. Thus, we do not need to offer you this right at this time.
Right to Limit the Use and Disclosure of Sensitive Personal Information: You have the right to limit the use and disclosure of Sensitive Personal Data.
Right to Opt Out of Automated Decision Making: Although California law permits you the right to opt out of automated decision making, including profiling, we do not process your Personal Information for that purpose. Thus, we are not offering you this right.
Right to No Retaliation / Discrimination: We will never retaliate nor discriminate against you if you choose to exercise any of your privacy rights.

2.7. Exercising Your California Privacy Rights

To exercise your access, correction and deletion rights described above, you can submit a request via the following methods:

Once we receive your request, we may attempt to verify your identity by sending you an email with a link to verify your email address. Following this, we may ask you one further verification question. Once the verification process is complete (if applicable), we will send you emails with login credentials to our secure privacy portal for you to access, download or instruct us to delete your Personal Information.

Once we verify your request, we will fulfill (or deny, where permissible and necessary) within 45 days of receipt. If we deny your request, or require more time, we will provide you with notice and explanation of the reason.

2.8. Use of Authorized Agent

You may use an authorized agent to submit a request to access, delete and to opt-out on your behalf if you provide the authorized agent written permission to do so and verify your own identity directly with us. “Authorized agent” means a natural person or a business entity that a consumer has authorized to act on their behalf. We may deny a request from an authorized agent who does not submit proof that they have been authorized by you to act on your behalf, unless you have provided the authorized agent with power of attorney, pursuant to Probate Code sections 4000 to 4465.
